1. Introduction

Welcome to JetaMediakit ("we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our platform, which provides verified social media metrics for content creators via OAuth integration with TikTok and Instagram.

By accessing or using JetaMediakit, you agree to be bound by these Terms and our Privacy Policy. If you do not agree with these Terms, you may not use our services.

2. Service Description

JetaMediakit is a platform that allows content creators to:

  • Verify their TikTok or Instagram accounts via OAuth
  • Display verified engagement metrics (average views, engagement rates, etc.)
  • Create shareable public creator profiles
  • Manage their profile data through a self-service dashboard
  • Control visibility and discoverability, including opting out of paid business search tools

Our service is free for creators and does not require account registration or passwords. Authentication is handled entirely through OAuth tokens from the respective social media platforms. In the future, businesses may pay for advanced search tools to discover creators (which creators can opt-out of).

3. Eligibility

To use JetaMediakit, you must:

  • Be at least 13 years old (or the minimum age required in your jurisdiction)
  • Have a valid TikTok or Instagram account that you control
  • For Instagram: have a Business or Creator account linked to a Facebook Page
  • Comply with all applicable laws and platform terms of service

4. User Responsibilities

When using JetaMediakit, you agree to:

  • Only verify accounts you own: You must have authorization to access the social media account you connect
  • Provide accurate information: All data displayed on your profile is fetched directly from platform APIs
  • Manage your session: Keep your manage session token secure (expires after 60 minutes)
  • Delete your data: You are responsible for requesting profile deletion when you no longer want to use the service

5. Prohibited Uses

You may NOT use JetaMediakit to:

  • Verify accounts you do not own or have authorization to access
  • Scrape, crawl, or automate access to the platform without permission
  • Manipulate or falsify metrics displayed on your profile
  • Attempt to gain unauthorized access to other users' data or profiles
  • Violate any applicable laws, regulations, or third-party rights
  • Introduce viruses, malware, or any harmful code
  • Use the service for spam, phishing, or fraudulent activities

6. Intellectual Property

Our Platform: All content, features, and functionality of JetaMediakit (including but not limited to design, code, text, graphics, and logos) are owned by us or our licensors and are protected by copyright, trademark, and other intellectual property laws.

Your Content: You retain all rights to your social media content. By using JetaMediakit, you grant us a limited license to display your public profile information and metrics solely for the purpose of operating the service.

Platform Data: Profile data, posts, and metrics are fetched directly from TikTok and Instagram APIs. We do not claim ownership of this data, but we may store it as described in our Privacy Policy.

Data is Not For Sale: We do not sell your data to third parties. Our revenue model is based on businesses paying for access to search and filtering tools within our directory—not for your personal data. You control whether you appear in paid business searches.

7. Service Availability & Modifications

No Guarantees: JetaMediakit is provided "as is" without warranties of any kind. We do not guarantee that the service will be uninterrupted, error-free, or always available.

Platform Limitations: Our service depends on third-party APIs (TikTok, Instagram). Changes to these APIs or platform policies may affect our functionality.

Modifications: We reserve the right to modify, suspend, or discontinue any part of the service at any time without notice.

Maintenance: We may perform scheduled or emergency maintenance that temporarily limits access to the platform.

8. Data & Privacy

Your use of JetaMediakit is also governed by our Privacy Policy, which explains:

  • What data we collect (public profile info, last 10 posts, OAuth tokens)
  • How we use and store your data (encrypted OAuth tokens, metric calculations)
  • Your GDPR rights (access, rectification, erasure, portability, object, withdraw consent)
  • Data retention (14-day grace period after deletion)

By using JetaMediakit, you consent to data collection and processing as described in the Privacy Policy.

Your Creator Profile Visibility & Control

When you verify your account on JetaMediakit, you control how your profile data is shared:

Public Profile Access (Default: ON)

Your profile is publicly viewable at /@yourhandle by anyone with the link. You can toggle this OFF in your manage dashboard to hide your profile entirely.

Free Public Directory (Default: ON)

Your profile appears in the free /creators directory for anyone to browse. You can hide from this directory in your manage dashboard.

Paid Business Search (Default: ON, Optional Opt-Out)

Future feature: Companies will pay to access advanced search/filtering of creator profiles. You can OPT-OUT of business search while keeping your profile public. This will be a separate toggle in your manage dashboard.

When opted out: Your profile remains public, but won't appear in paid business searches.

Data Sales Policy: We Will NEVER Sell Your Data

  • We will NEVER sell, rent, or share your personal data or metrics with third parties
  • The paid business search feature is NOT data sales—it's paid access to our directory search tool
  • Businesses pay US for search access; your data remains under your control
  • You can opt-out of business search, hide from directory, or delete your profile anytime

Free for Creators, Paid for Business Access

  • JetaMediakit is FREE for creators forever (verification, profiles, metrics, management)
  • Businesses will pay for advanced search/filtering tools to discover creators
  • Revenue model: Businesses pay for search features, NOT for your data
  • You decide if you want to be discoverable in paid business searches

9. Email Communications & Mailing List

Optional Mailing List Subscription

JetaMediakit offers an optional mailing list for users who want to stay updated about platform news, new features, and creator resources.

Completely Optional

Subscribing to the mailing list is NOT required to use JetaMediakit. You can use the platform without subscribing to marketing emails.

Double Opt-In Confirmation

When you subscribe, we send a confirmation email via MailerSend (transactional email service) to verify your email address. You must click the confirmation link to complete your subscription.

Marketing Emails via MailerLite

After confirmation, your email is added to our marketing list managed by MailerLite. You'll receive:

  • Platform updates and new feature announcements
  • Creator success stories and tips
  • Industry insights and trends
  • Exclusive creator resources and opportunities

Unsubscribe Anytime

Every marketing email includes an unsubscribe link. You can also unsubscribe by visiting our website or contacting privacy@jetaviews.com. Unsubscribing removes your email from both our database and MailerLite.

Data Storage & Processing

Your email address and subscription preferences are stored in our database and synced with MailerLite for marketing purposes only. MailerLite is GDPR-compliant and processes data according to their Privacy Policy.

No Spam, No Data Sales

We respect your inbox. We send emails only about relevant platform updates (typically 1-4 emails per month). We NEVER sell, rent, or share your email address with third parties for marketing purposes.

Transactional Emails: Separately from the optional mailing list, we may send transactional emails (e.g., account verification, password resets if applicable in the future) that are necessary for service operation. These emails are sent via MailerSend and cannot be opted out of as they are essential to the service.

Your Consent: By subscribing to the mailing list, you explicitly consent to receiving marketing communications from JetaMediakit as described above. This consent is separate from and in addition to your use of the platform itself.

10. Limitation of Liability

⚠️ IMPORTANT: Please read this section carefully

To the maximum extent permitted by law, JetaMediakit and its operators shall not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or business opportunities
  • Service interruptions, errors, or data loss
  • Actions or inactions of third-party platforms (TikTok, Instagram)
  • Unauthorized access to or use of our servers or your data

Accuracy of Metrics: While we strive for accuracy, we do not guarantee that metrics displayed are error-free. Metrics are calculated based on data provided by third-party APIs.

11. Indemnification

You agree to indemnify, defend, and hold harmless JetaMediakit and its operators from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use or misuse of the service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Unauthorized access to accounts you do not own

12. Termination

Your Right to Terminate: You may stop using JetaMediakit at any time by deleting your profile. A 14-day grace period applies, after which your data is permanently deleted.

Our Right to Terminate: We reserve the right to suspend or terminate access to any profile that violates these Terms or engages in prohibited activities, without prior notice.

Effect of Termination: Upon termination, your right to use the service ceases immediately. Data deletion follows our retention policy as described in the Privacy Policy.

13. Dispute Resolution

Informal Resolution: If you have any concerns or disputes, please contact us at support@jetaviews.com first. We'll work to resolve issues amicably.

Governing Law: These Terms are governed by the laws of [Your Jurisdiction - to be specified], without regard to conflict of law principles.

GDPR Jurisdiction: For EU users, GDPR rights take precedence. You may lodge complaints with your local data protection authority.

14. Changes to These Terms

We may update these Terms from time to time. When we make material changes:

  • We will update the "Last Updated" date at the top of this page
  • For significant changes, we may display a notice on the platform
  • Your continued use of the service after changes constitutes acceptance

We recommend reviewing these Terms periodically to stay informed of any updates.

15. Third-Party Services

JetaMediakit integrates with third-party platforms (TikTok, Instagram). Your use of these platforms is subject to their respective Terms of Service:

We are not responsible for the availability, functionality, or policies of these third-party services.

17. Severability & Entire Agreement

Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and JetaMediakit regarding the use of our service.

No Waiver: Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

Acknowledgment

By using JetaMediakit, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree with these Terms, please discontinue use of the service immediately.
